Errors in the Abortion Debate

I've waited an extremely long time to post this entry. I had hoped that by now both sides of this debate would recognize (and correct) their reasoning errors, but they have not.

Attention Pro-choice Advocates:

There is no need to worry about Roe v. Wade being overturned. It has already happened. You need to look to the recent precedent Planned Parenthood of Southeastern Pennsylvania v. Casey. It's called the "Undue Burden Standard."

Your glimmer of hope rests in the fact that abortions are safer than carrying a pregnancy to full term. So when dealing with "maternal health," an abortion is the best medical decision. Afterall, the State has a greater interest in protecting the rights of actual citizens over potential citizens.

Attention Pro-life Advocates:

The Constitution does in fact protect a women's right to choose to terminate her pregnancy. In a free market, abortion will exist naturally and is a form of contraception, albeit a barbaric one. Contraception is under procreation; procreation is under privacy; privacy is a Substantive Due Process Right via the Due Process Clause of the 14th Ammendment.

Your glimmer of hope rests in the fact that Justice O'Connor wrote the majority opinion. Since she often cast the tie-breaking vote, her upcoming retirement provides the opportunity for a political ideology shift in the Supreme Court. Irregardless, legal action is not the proper route to take. Instead, use moral appeals.
